These terms apply to your use of this website. Please read them — they explain what this site is, what it is not, and how we are paid.

1.Who we are
This website is operated by Hello Capital, a trading name of Hello Capital Pty Ltd, ABN 1234567890, of Building 1/658 Church St, Cremorne VIC 3121.
We are authorised to engage in credit activities under the National Consumer Credit Protection Act 2009 (Cth) as the holder of Australian Credit Licence 1234567890. We are a member of the Australian Financial Complaints Authority; our membership number is 1234567890.
We are a finance broker. We are not a lender. We provide credit assistance — we suggest credit products and assist you to apply for them. The credit itself is provided by the lender, on the lender’s terms.
2.Accepting these terms
By using this website you agree to these terms. If you do not agree with them, please do not use the site. We may update these terms from time to time; the version on this page at the time you use the site is the one that applies, and the last-updated date is shown above.
3.Our content is general information, not credit advice
Everything on this website is general information only. It does not take into account your objectives, financial situation or needs.
Nothing on this site is:
- credit advice, financial advice, tax advice or legal advice;
- an offer of credit, or an invitation to apply for a specific credit product;
- a promise that credit will be approved or made available to you; or
- a recommendation that a particular product is suitable for you.
A recommendation only comes from us after we have assessed your circumstances, and it is given to you in writing in a credit proposal disclosure. Before acting on anything you read here, consider whether it is appropriate for you and seek advice from a qualified professional.
All finance is subject to lender approval and assessment. Credit criteria, terms, conditions, fees and charges apply, and they are set by the lender, not by us.
4.Rates, repayments and borrowing-power figures are indicative only
Any interest rate, comparison rate, repayment amount, borrowing capacity, funding range, timeframe or other figure shown on this site — including anything produced by a calculator or estimator — is indicative only and is not a quote, an offer or a pre-approval.
Figures of that kind are illustrations based on assumptions that may not match your circumstances. They do not account for all fees and charges, and they may be out of date. Actual rates, repayments and amounts available are determined by the lender after a full assessment, and will differ.
Statements about our experience, the size of our lender panel, funding ranges or approval speeds describe what we generally do. They are not commitments about your matter, and no outcome is guaranteed.
5.Our best interests duty
When we provide credit assistance in relation to a consumer credit contract, the law requires us to act in your best interests and to give priority to your interests if there is a conflict between yours and ours. This is the best interests duty under the National Consumer Credit Protection Act 2009 (Cth), and ASIC Regulatory Guide 273 sets out how it applies.
Nothing on this website, and nothing in these terms, limits or excludes that duty. The duty cannot be avoided by any notice, disclaimer, disclosure or consent, and we do not attempt to do so. This clause describes the duty; it does not qualify it.
Where we recommend a product, we will explain why we consider it to be in your best interests, including why it was preferred over the alternatives we considered.
6.How we are paid — commissions and fees
We are paid commission by lenders when a loan we arrange settles. This usually takes two forms: an upfront commission, calculated as a percentage of the amount drawn down, and a trail commission, calculated on the outstanding balance over the life of the loan. Commission rates differ between lenders and between products.
Because commission differs between lenders, there is an inherent conflict of interest in what we do. We manage it by acting in your best interests as described in section 5, and by disclosing what we are paid.
Where the actual numbers are given. The amounts, and how they are worked out, are disclosed to you in two documents before you are committed to anything:
- our credit guide, which we give you before we provide credit assistance. It sets out who we are, our licence details, the lenders we work with most, how we are paid, and how to complain; and
- our credit proposal disclosure, which we give you when we propose a particular product. It states the commission we expect to receive on that specific loan, and any fee you would pay.

We may also pay a fee to a person who refers you to us. If that applies to your matter, we will tell you.
7.Information you give us
You agree that the information you give us — through the contact form, by phone or in an application — is true, accurate and complete, and that you will tell us if it changes. We rely on it, and lenders rely on it. Giving false or misleading information in a credit application is a serious matter and can be an offence.
How we handle your information is set out in our privacy policy, which forms part of these terms.
8.Intellectual property
Unless stated otherwise, the content of this website — text, layout, graphics, photographs, logos and the Hello Capital name and marks — is owned by us or licensed to us, and is protected by copyright and trade mark law.
You may view this site and print or download extracts for your own personal, non-commercial use. You may not otherwise reproduce, adapt, republish, frame or commercially exploit any part of it without our written permission.
Third-party names and logos on this site, including those of lenders, remain the property of their respective owners and are used to identify them. Their appearance does not imply any endorsement of us by them.
9.Third-party links and content
This site may link to websites we do not control — lenders, regulators and information services. We provide those links for convenience only. We do not endorse, and are not responsible for, the content, products, services, accuracy or privacy practices of any third-party site. Read their terms and privacy policies before using them.
10.Availability of the site
We try to keep this site available and its content current, but we do not guarantee that it will be uninterrupted, error-free, or free of viruses or other harmful components. We may change, suspend or withdraw any part of the site at any time without notice.
11.Limitation of liability
To the maximum extent permitted by law, and subject to the paragraph below, we exclude all liability for any loss or damage — including indirect or consequential loss — arising from your use of this website or from reliance on any information on it.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the relevant services or paying the cost of having them re-supplied.
For the avoidance of doubt, this section does not limit our best interests duty or any other obligation we owe you under the National Consumer Credit Protection Act 2009 (Cth).
12.Complaints
If something has gone wrong, tell us first. Call 1300 000 000, email hello@hellocapital.com.au, or write to us at Building 1/658 Church St, Cremorne VIC 3121. We will acknowledge your complaint within seven days and give you our decision within 30 days.
If you are not satisfied with our response, or we have not responded within 30 days, you can take your complaint to the Australian Financial Complaints Authority. AFCA is free to consumers and its decisions are binding on us. Our membership number is 1234567890.

13.Australian users only
This website is directed at people in Australia. The finance we arrange is available only to Australian borrowers, and the information here is written for Australian law and market conditions. If you access this site from outside Australia, you do so on your own initiative and are responsible for complying with your local laws.
14.Governing law
These terms are governed by the laws of the State of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts that hear appeals from them.
If any part of these terms is found to be unenforceable, that part is severed and the rest continues to apply.
